(a) That the Carrier violated the Controlling Agreement (farming out of work) when on April 24, 1974 an outside contractor (Esco Company) raised into place a 60' hood used for ventilation in the new building on Track #9 at the South Louisville Shops, Louisville, Kentucky.

(b) That the Carrier be required to pay the top three machinists on the Rigging Gang Miscellaneous Overtime Board eight (8) he:zrs each at penalty rate, and pay the top man on the Fro=cn Group Miscellaneous Ovcxtime Board eight (8) hours of penalty rate for Pettibone Operator.

The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex rte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the employer t the case be withdrawn.
