Dispute: Claim of Employes:
1. The REA Express, hereinafter referred to as the Company, violated
 
the controlling Agreement with the International Association
 
of Machinists 
and Aerospace Workers, hereinafter referred to as
 
the Union, when they failed to replace tools stolen due to a
 
break-in on the week end 
of 
November 16, thru the 18, 1974.
 
Claimants are Dennis McLellan, Duane Kuchenneister and Terry
 
Trudeau; and again following a break-in on the week end 
or
 
January 18, 1975, when the claimants are Paul Gazdik and Dennis
 
McLellan, all of which is in violation of Rule 88 of the controlling
 
Agreement.
Statement:
The-above question was submitted to the Second Division of the Natiora 1
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon. was waived,.and the Division is now in receipt of a request from
the employes that the case be withdrawn.
