Dispute: Claim of Emploves:

            1. That the Kentucky & Indiana Terminal Railroad Company defaulted in the procedural appeal handling of, and; otherwise willfully and wrongfully suspended Electrician K. E. Woodruff on January 21, 1974, with formal dismissal by notice effective January 30, 1974, without just: and sufficient cause, subsequent to investigation held on January 28, 1974, in violation of Rules 28, 29, 30, and 124.


        2. That, accordingly;, the Kentucky & Indiana Terminal Railroad

        Company be ordered to restore Claimant, Electrician K. E. Woodruff,

        to service with seniority rights unimpaired, that he be compen

        sated for all monetary loss due to his dismissal from service

        and with all privileges, such as insurance, vacations, holidays,

        etc. , unimpaired.


Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing thereon was hello, and the Division is now in receipt of a request from the employes thatthe case be withdrawn.
