Parties to Dispute: ( Electrical Workers
( Missouri Pacific Railroad Company
Dispute: Claim of Employes:
1. That the Missouri Pacific Railroad Company violated and continues
to violate the Apprentice Agreement by denying to Apprentice
Electrician R. E. Burge the rate guarantee as set forth in the
January 31, 1973 Letter Agreement.
2. That, accordingly, the Missouri Pacific Railroad Company be
ordered to make Electrician Apprentice R.
E.
Burge whole with
respect to the difference between his prior in-service classification pay rate and the apprentice basic rate; and
3. That such adjustment be computed from January 7, 1974 and shall
be continuous until such time as this violation is otherwise
corrected.
Findings:
The Second Division of the Adjustment Board, upon the whole record and
all the evidence, finds that:
The carrier or carriers and the employe or employes involved in this;
dispute are respectively carrier and employe within the meaning of the Railway
Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute
involved herein.
Parties to said dispute waived right of appearancd at hearing thereon.
The basic issues and elements in this case are essentially the same
as those contained in that case between these same parties which resulted in
our Award No. 7018. On this basis the claim will be denied.
