1. The Carrier violated the Scope Rule, Rule 27(0) and Rule
51 of the current Shop Crafts Agreement effective April 1,
1970, and Labor Agreement No. 77-69, dated December 7, 1969
appearing on Pages 121, 122 and 123 of the April 1, 1970
Shop Crafts Agreement, when it permitted Maintenance of Way
Department employes, not covered by the April 1, 1970 Shop
Crafts Agreement, to perform the work of repairing mechanical
track tampers in the Seventh Street Roundhouse at Denver,
during the period January 8, 1974 to Febria ry 9, 1974,
inclusive.
2. E. R. Klaus and F. R. Derrera, Machinists, Denver, be paid
eight (8) hours each, computed at time-and-one-half rate on
twenty (20) days occurring during the period January 8, to
February 9, 1974, inclusive.
Statement
The above question was submitted to the Second Division of the
National Railroad Adjustment Board by the above referred to organization
in ex parte form, hearing thereon was waived, and the Division is now
in receipt of a request from the employes that the case be withdrawn.
