1. That the Texas and Pacific Railway Company violated the
controlling Agreement, particularly Rule 65 at Fort Worth,
Texas, on January 23, 1974 when they improperly assigned
Carmen the duties of piping new Micropher commode by cutting
bending and fitting water and air lines of copper lines also
applying waste disposal lines on Caboose No. 13114.
2. That accordingly the Texas and Pacific Railway Company be
ordered to compensate Sheet Metal Worker D. E. Black
sixteen (16) hours at the pro rata rate of pay for such
violation.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
