1. That the Texas and 
Pacific Railway Company 
violated the
controlling Agreement, particularly Rule 
65 
at Fort Worth,
Texas on January 1$, 197+ when they improperly assigned
Carmen the duties of piping new Mierophor commode by cutting,
bending and fitting water and air lines 
of 
copper pipe also
applying waste disposal lines, on Caboose No. 13090.
2. That accordingly the Texas sad 
Pacific Railway Company 
be
ordered to compensate Sheet Metal Worker J. R. Irhirphy sixteen
(16) 
hours at the pro rata rate of pay for such violation.
Statement:
The above question 
was 
submitted to the Second Division of the
National Railroad Adjustment Board by the above referred to organization
in ex parts form, hearing thereon was waived, and the Division is now in
receipt of a request from the employee that the case be withdrawn.
