1. That the Texas and Pacific Railway Company violated the
controlling Agreement, particularly Rule
65
at Fort Worth,
Texas on April
30, 1874,
when they improperly assigned Carman
Perkins the duties of removing pipes from old commode and
wash basin, applying new pipes to Microphor commode and re
locating wash basin and applying new pipes by cutting, bending
and fitting water and air lines of copper and galvanized pipe, also
applying waste disposal lines on Caboose No.
10395·
2. That accordingly the Texas and Pacific Railway Company be
ordered to compensate Sheet Metal Worker M. D. Marr sixteen
(16) hours at the pro rata rate of pay for such violation.
Statement:
The above question was submitted. to the Second Division of the
National Railroad Adjustment.Board by the above referred to organization
in ex pane form, hearing thereon was waived, and the Division is now in
receipt of a request from the employee that the case be withdrawn.
