1. That the Texas and Pacific Railway Company violated the
controlling Agreement, particularly Rule
65,
at Fort Worth,
Texas on May 29, 197, when they improperly assigned Carman
Perkins the duties of removs.Ag pipes from old commode and
wash basin, applying new pipes :o Mtcrophor commode and relocating wash basin and applying nest pipes by cutting, bending
and fitting water and air lines of copper and galvanized pipes,
also applying waste disposal lines on Caboose No. 13154.
2. That accordingly the Texas and Pacific Railway CompaaW be
ordered to compensate Sheet Metal Worker C& C. Malone sixteen
(16) hours at the pro rata rate of pay for such violation.
Statement:
?he above question was submitted to the Second Division of the
National .Railroad Adjustment Hoard by the aboveoreferred to organization
in ex parte form,, hearing thereon was waived, and the Division is now %n
receipt of a request from the employee that the case be withdrawn.
