Dispute : Claim of Employe§.L,

1. That on Wednesday, October 17,= 1973, the Terminal ~ilroad Association of St. Louis, Missouri violated the Controj~ling Agreement, particularly Rule 26, when Carrier supervisor disc patched a Brooklyn Shop Electrician, Otto rtof8le, to make the Federal field inspection on Unit 559 at Madisoq Pit, Illinois, in 1ieu of calling and using an elept-xicion from the Bremen Avenue-loth Street Shop seniority point.

2. That, accordingly, the Terminal Rpilrqpd Assqc#tion of St. Louis be ordered to compensate (Bremen Avenge - 14th Street) Electrician B. R. Odom four hours' pay, at time and one·h,olf, for this October 1'l, 1973 violation; and,

3. That, in addition thereto, Carried be further ordered to p8y to the Claimant, an accrued interest orb the principal amount claimed, computed at 6% per anr~um and compounded annually foam the anniversary date of the claim. '

Findings:

The Second Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The Carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employe withinltho meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.

Parties to said dispute waived right of appearance at hearing thereon.

The facts contained in this dispute are identical with the facts contained in Award No. 7162 . Therefore, this claim will be denied for the same reasons as contained in Award No. 7162 .
