Dispute: Claim of Employes

    1. That under the current agreement, 'Myron A. Wilburn, Machinist Helper, Milwaukee, Wisconsin was improperly dismissed from service of the Carrier on February 6, 1975, as a result of formal investigation conducted on January 21, 1975, on account alleged insuborination charges. Carrier's dismissal of Claimant is unjust, capricious and unwarranted.-


That accordingly, the Carrier be ordered to restore Myron A. Wilburn, hereinafter referred to as the Claimant, to service with all seniority and vacation rights unimpaired with pay for all lost wages, including premium payments for Hospital, Surgical and Medical Benefits and. for Group Life Insurance for all. time Claimant is held out of service.

Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in exparte form, hearing thereon was waived, and the Division is now in receipt of a request from the employes that the case be withdrawn.
