Dispute: Claim of 'Employes:
"1. That under the Controlling Agreement, the Baltimore and
Ohio Railroad Company, violated the grievance procedure
of the Agreement - Time Limits, therefore the grievance
should be allowed as submitted.
2. Furthermore, under said Controlling Agreement, the Carrier
arbitrarily and capriciously damaged Machinist J. Ciotola,
when they forced him on an assignment not of his choice at
Jessup, Maryland, which was created by the retirement of
Machinist T. McShane, who had covered the assignment prior
to his retirement.
3. That the Carrier be ordered to bulletin an assignment at
Riverside `tractor (Baltimore Terminal Shop) Shop, with
tour of duty beginning and ending at said shop to cover
said assignment at Jessup, Maryland."
Statement:
The above question was submitted to the Second Division of the
National Railroad Adjustment Board by the above referred to organization
in ex parte form, hearing thereon was waived, and the Division is now
in receipt of a request from the employes that the case be withdrawn.'
