1. That under the current agreement, Electrician Third Railman Truck L. E. tfassard was imporperly compensated for service which he rendered on December 5 and December 6, 1975.

2. That the Carrier additionally compensate the aforesaid employe the difference between the time and one-half rate and the double tune rate for work between the hours of 8:00 a.m. and 12:00 noon on December 6, 1975.

Statement:

The above question was submitted to tlte Second Division of the National Railroad Adjustment Hoard by the above referred to organization in ex parte form, hearing thereon was waived, and the Division is nova in receipt: of a request from the employer that the case he withdrawn.
