Dispute: Claim of Employes:
1. That the Missouri Pacific Railroad Company violated the rights of
Carman G. E. Skidmore, Dupo, Illinois, when he was unjustly
withheld from service from June 21 through July 1,
197+,
inclusive.
2. That accordingly, the Missouri Pacific Railroad Company be ordered
to compensate Carman Skidmore in the amount of eight hours
(8')
per day at straight time rate for the period covering-June 21
through July 1,
197+.
Findings:
The Second Division of the Adjustment Board, upon the whole record and
all the evidence, finds that:
The carrier or carriers and the employe or employes involved in this
dispute are respectively carrier and employe within the meaning of the
Railway Labor Act as approved June 21,
193+.
This Division of the Adjustment Board has jurisdiction over'the dispute
involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
A careful review of the record in this dispute compels the conclusion
that Carrier did not unreasonably hold Claimant out of work pending evaluation
of Claimant's physical condition by Carrier physicians.
