 Accordingly, this Board has carefully ..revicwod the :investigative transcript to insure that clazrnant -was provided a. fair and inpaftial hearing We do not find, after COr1Ci.U.Cting this examination, that Carrier acted arbitrary, capricious or singularly p?°ejudicia'al- ire. this proceeding.

 We well n:i.Jh recognize the i.nc.vl-table adverse.ra_al propensities fox viewing differently the hearing txa,nscr:i_nt, but we do not find the conclusion herein at variance with the facts.

 This Board has consistently observed the principle. so eloquently expressed in Second Divis:i.on Award (?_787) that "v.,re are not the Criers of the facts. Our duty :i.s to establish only that a fair hearl.nr; required by the rules has been given and not to substitute our judgement for those who have had a direct and in~nediate oppor-f-,u.nity to evaluate the ,,-itnesses and their evidence." -vie do not find any justification for deviating iron. this decisional -rule.

    Claimant had been adjudged guilty of serious misconduct offense ti:at

was fraught with potential dangers. TTe 'was di:;charged for a Rule G
 violation on h_p;~:il 12, 1965 and then reir.stated to Service on December 2'T,
 1665. He was again disci"arged for sa~e violation on August
 1970 and agal _n reinstated to service or, i:ove::~;er 26, 1977... This is his
 third Rule G violation, wh_ch is also Jo-I.ned with insubordination.

 Surely under these un-I_que and repetitive circu::istances and the compelling safety imperatives of this industry, it would be unv;artanted, on our part, to .reverse Carrier's disposition. We will deii;,T the claim.
