Dispute; Claim of Employes:

        1. Under the current controlling Agreement, Mx. E. C. Titus., former laborer, Salt Lake City, Utah, was unjustly dealt with and dismissed from service of The Denver and Rio Grande Western Railroad Company, effective April h+, 1977.


        2. That, accordingly, The Denver and Rio Grande Western Railroad Company be ordered to reinstate Mr. E. C. Titus to service; with payment fox time lost at the pro rata rate, including all fringe benefits and reference to this incident stricken from his record.


Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex _paxte foam, hearing thereon was waived, and the Division is now in receipt of a request from the employes that the case be withcIxawn.
