1. That the Southern Pacific Transportation Company (Texas and
Louisiana Lines) violated Article VII of the AS3~eement of December
4, 1875,
when on T;ovember 1_4 and 15, 1976, they used employes
(grounCimen) of Pat Baker Contracting Co. to assist Carmen in
clearing a der°~.ihment at Cuero, Texas.
2. That accordingly, the Southern Pacific Transportation Company
(Texas and Louisiana Lines) be ordered to compensate Wrecker Crew
Members I. C. Martinez and 0. E. Cude in the aamount of twelve
hours (12' ) each at the overtime rate for November
14,
1970>, and
compensate Wrecker Crew Mi-embers B. S. Martinez and W. 0. Mabry
in the amount of twelve hours (12') each at the overtime rate for
November 15, 1976.
Statement:
The above question was submitted to the Second Division of the

Railroad Adjustment Board by the above referred to organization in e.-.1 .pane
form, hearing thereon was waived, and the Division is now in receipt of a
request from the employer that the case be withdrawn.
