1. Freight Car Welder James A. Balom was unjustly assessed thirty (30)
days suspension and made to serve an additional fifteen
(15)
days
suspension which had been previously deferred, on April 10,
1978.
2. Freight Car Welder James A. Balom was erroneously charged with his
absence on March
15, 16, 17,
and 30, 1978.
3.
That the Chicago and North Western Transportation Company be ordered
to compensate Freight Car Welder James A. Balom for all lost time,
plus 6%
annual interest; and make him whole for all vacation rights,
holidays, sick leave benefits, and all other benefits that are a
condition of employment, as per Rule
35.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the employes that the case be withdrawn.
