1. Carman Albert Martin was unjustly assessed sixty (60) days suspension
on May
18, 1978.

Carman Albert Martin was erroneously charged with failure to properly
report an injury incurred on April
3, 1978,
at Smithwick, South
Dakota.
3.
That the Chicago and North Western Transportation Company be ordered
to compensate Carman Albert Martin for all time lost, plus

annual interest; and make him whole for all benefits which are a
condition of employment, in accordance with Rule
35
(h).
Statement:
The above question was submitted to the Second Division of the National.
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the employes that the case be withdrawn.
