1. That the Norfolk and Western Railway Company violated Rule 68 of the
controlling Agreement and Memorandum of Agreement dated January 10,
1962, beginning October 18, 1977, at Brewster, Ohio.
That the Norfolk. and Western Railway Company violated Safety Rule 1302
and Federal Railroad Safety Act of 1970, Subpart B--Blue Signal
Protection of Workmen--Sections 218.21 through 218.29, beginning
October 18, 1977, at Brewster, Ohio.

That the Norfolk and Western Railway Company be ordered to compensate
Carman J. E. Burdge eight (8) hours' pay, five
(5)
days a -week,
beginning October 18, 1977, until this claim is closed.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request fray
the employes that the case be withdrawn.
