insubordination on August
3, 1978.

That the Chicago and North Western Transportation Company be ordered-to
make Freight Car Inspector Mark Foster whole; return him to service with
all seniority rights, vacation rights, holidays and all other benefits
which are a condition of employment, dating from August 3,
1978,
in
accordance with Rule 35(h).
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request
from the employes that the case be withdrawn.
