1. That in violation of the current agreement, Roy C. Collins,, laborer
was unjustly assessed five demerit marks from his service record
following investigation held on date of May 11,
1978.
2. That accordingly the Carrier be ordered to make the aforementioned
Roy Collins whole by removing the five demerit marks from his service
record plus additional relief desired.
Findings
The Second Division of the Adjustment Board, upon the whole record and a11.
the evidence, finds that:
The carrier or carriers and the employe or employes involved in this dispute
are respectively carrier and employe within the meaning of the Railway Labor
Act as approved June 21,
193+.
This Division of the Adjustment Board has jurisdiction over the dispute
involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
Claimant was assessed five demerit marks for violation of Rule x+001, GT
Safety Rules, and Rule 6A, GT General rules. "Failure to obtain immediate first
aid or medical attention for all injuries." Claimant was guilty and the
penalty is not excessive nor arbitrary.
