1. That the Missouri Pacific Railroad Company violated Rules 3, 4-Section
1 (a),

(a), and 7 (a), (d) and (g) of the Communications
Agreement effective August 1, 1977 when they denied Communications
Maintainer J. A. Hoyt at Wichita, Kansas the overtime provisions
of the Agreement, i.e., two and seven-tenths (2.7') at the overtime
rate for February 8, 1978.
2. That, accordingly, the Missouri Pacific Railroad Company be ordered to
compensate Communications Maintainer J. A. Hoyt two and seven-tenths
hours (2.7') at the overtime rate for February 8, 1978.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the employes that the case be withdrawn.
