provisions of Rule 27 (a) of the Communications Agreement effective

by failing to decline the Local Chairman's claim

when they denied Communications
Maintainer H. G. Heise at Dupo, Illinois the overtime provisions of the
Agreement, i.e., four hours (4') at the overtime rate for work performed
outside his bulletined hours - x+:00 p.m. to 8:00 p.m. - on a holiday,
February 20, 1978.

That, accordingly, the Missouri Pacific Railroad Company be ordered
to compensate Communications Maintainer H. G. Heise four hours

at the overtime rate for February 20, 1978.

ment:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a request
from the employes that the case be withdrawn.
