1. That the Missouri Pacific Railroad Company violated Rules 3, 4-Section
1 (a),

(a),
6
(a), and 7 (a), (d) and (g) of the Communications
Agreement effective August 1, 1977 when they denied Communications
Maintainer J. J. Hoggard at Poplar Bluff, Missouri the overtime
provisions of the Agreement, i.e., two and seven-tenths hours (2.7')
at the overtime rate for work performed outside his bulletined hours -
5:00 P.m. to
6:30
P.m. on April 22, 1978.
2. That, accordingly, the Missouri Pacific Railroad Company be ordered to
compensate Communications Maintainer J. J. Hoggard two and seven-tenths
hours (2.7') at the overtime rate for April 22, 1978.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a request
from the employes that the case be withdrawn.
