1. That the St. Louis-San Francisco Railway Company violated the current
agreement particularly Rule 1 when last half of July,
1978
pay period
of
Electrician Jay Luce was docked twelve (12) hours at
$7.66
per hour.
2. The claim to, Electrician Jay Luce account of walking around with
O.S.H.A. on Company property for twelve (12) hours at
$7.66
per hour
plus ten per cent (1w) interest be made whole for time withheld by the.
St. Louis-San Francisco Railway Company.
Findings
The Second Division of the Adjustment Board, upon the whole record and all
the evidence, finds that:
The carrier or carriers and the employe or employes involved in this dispute
are respectively carrier and employe within the meaning of the Railway Labor Act
as approved June 21,
1934.
This Division of the Adjustment Board has jurisdiction over the dispute
involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
The facts associated with this claim by Mr. Luce are identical in all
important aspects with those related in Award
8648.
The only difference resides
in the days and amounts claimed.
For the reasons outlined in Award No.
8648
we find that there is no contractual
basis upon which payment of the claim can be directed.
