1. That the South Buffalo Railway Company violated the controlling Agreement
when they failed to observe seniority in awarding positions under the
Agreement which allows carmen, car inspectors, and helpers to change
assignments the first Wednesday of March and September.
That Carmen R. Burger, J. Bialecki, G. Dusch, and R. Prizel were denied
their rights to positions they submitted bid on, and junior employes were
awarded the positions by Award Bulletin No. 79-19.

That accordingly, the South Buffalo Railway Company be ordered to rescind
the awards in Award Bulletin 79-19, and that Carmen Burger, Bialecki, Dusch,
and Prizel be allowed to assume the positions they submitted bids on
which were assigned to junior employes.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
