Dispute: Claim of Employes:
(1~ That the Union Pacific Railroad Company has unjustly dealt with Carman
J. A. White, North Platte, Nebraska, when he was dismissed from service
on September 28, 1979, for allegedly violating Rules Governing Duties
and Deportment of Employes, Safety Instructions and Use of Radio.
(2) That accordingly the Union Pacific Railroad be ordered to reinstate J. A.
White to his former position as stated in Rule 37 of the Agreement dated
November 1, 197&, with all vacation and seniority rights, all Health and
Welfare Insurance Benefits, all credit under Railroad Retirement and
Unemployment Insurance Benefits, pay for all time lost, at the prorata rate
of pay of the Carman during the period of his dismissal, and any other
benefits he would have earned while dismissed from service.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form;,
hearing thereon was waived, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
