Dispute: Claim of Employes:
1. That the South Buffalo Railway Company violated the controlling agreement
when they improperly removed Carman John E. Greene from his regular
position (#17) and assigned him to position WR-2 covered in Bulletin
#79-20.
2. That the South Buffalo Railway Company failed to assign Carman J. Kennedy
(the junior Carman without an assigned position) to position WR-2 which
was bulletined in accordance with Rule 15 but no bids were received from
any employe desiring the position.
3.
That accordingly, the South Buffalo Railway Company be ordered to return
Carman John E. Greene to his regular position (#17) and that he be
compensated in the amount of eight

hours pay at the straight time
rate for every day he is held from his position. Further, that Junior
Carman J. Kennedy be assigned to position WR-2 covered in Bulletin #79-20.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form;,
hearing thereon was waived, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
