Dispute: Claim of Employes:
1. That the Bessemer and Lake Erie Railroad Company violated the controlling
Agreement when it unjustly dismissed Carman W, G. Consiglio from service
on December 20, 1979, as a result of investigation held on November 28,
1979, at Greenville, Pennsylvania.
2. That the Bessemer and Lake Erie Railroad Company be ordered to reinstate:
Carman W. G. Consiglio to service with all seniority and vacation
rights unimpaired, and all other rights and benefits that would have been
afforded to him under contract had he not been unjustly dismissed.
3. That the Bessemer and Lake Erie Railroad Company be ordered to make Carman
W, G. Consiglio whole for all wages lost account his unjust dismissal from
service, beginning with his demonstration of being capable to return to
service.
Statement:
The above question was submitted to the Second Division of the National Railroad
Adjustment Board by the above referred to organization in ex parte form, hearing
thereon was waived, and the Division is now in receipt of a request from the employes
that the case be withdrawn.
