Parties to Dispute:
(Illinois Central Gulf Railroad Co.
Dispute: Claim of Employes:
1, That under the current Agreement, Upgraded Cayman Apprentice K. L. Brown,
Johnston Car Shop, Memphis, Tennessee, was unjustly suspended from the
service of the Illinois Central Gulf Railroad for a period of ninety (9(>)
calendar days, beginning February 18, 1980, up to and including May 17,
1980, as result of investigation held on January 14, 1980.
2. That accordingly, the Illinois Central Gulf Railroad be ordered to:
A. Compensate Upgraded Cayman Apprentice K, L. Brown for all time lost,
beginning on February 18, 1980, in the amount of eight (8) hours per day
at the pro rata rate, up to and including May 17, 1980, at which time
he may return to service.
B. Compensate Upgraded Cayman Apprentice K, L. Brown for all overtime:
he might have enjoyed during the ninety (90) days he is being suspended
from service.
C. Apply all time lost, due to his suspension, toward his apprenticeship
and his vacation, and make him whole for any and all other benefits
he would be entitled to as a condition of employment had he not been
suspended for ninety (90) days.
Statement:
The above question was submitted to the Second Division of the National Railroad
Adjustment Board by the above referred to Organization in ex parte form, hearing
thereon was waived, and the Division is now in receipt of a request from the carrier
that the case be withdrawn.
