addition Referee John B. LaRocco when award was rendered.
(Brotherhood Railway Carmen of the United States and Canada
Parties to Dispute:
( Illinois Central Gulf Railroad Company
Dispute: Claim of Employes:
1. That under the current Agreement, Upgraded Carman Apprentice K. L. Brown,
Johnston Car Shop, Memphis, TN, was unjustly suspended from the service
of the Illinois Central Gulf Railroad for a period of thirty (30) days,
beginning on January 18, 1980, and continuing through February 16, 1980,
as result of an investigation which was held on Tuesday, October 30, 1979.
2. That accordingly, the Illinois Central Gulf Railroad be ordered to:
A. Compensate Upgraded Carman Apprentice Brown for all time lost in the
amount of eight (8) hours per day at the pro rata rate beginning
on January 18, 1980, up to and including February 16, 1980.
B. Compensate Upgraded Carman Apprentice Brown for all overtime he would
be entitled to during the thirty (30) days he was suspended from the
service.
C. Apply all time off toward his apprenticeship and his vacation; and make
him whole for all other benefits he would be entitled to as a condition
of employment during the 'thirty (30) days in which ha was out of
service.
Statement:
The above question was submitted to the Second Division of the National Railroad
Adjustment Board by the above referred to Organization in ex parte form, hearing
thereon was waived, and the Division is now in receipt of a request from the Carrier
that the case be withdrawn.
