Dispute: Claim of Employes:
1. That under the current Agreement, Carman A. C. Johnson, Baton Rouge,
Louisiana, was unjustly suspended from the service of the Illinois
Central Gulf Railroad for a period of 30 calendar days beginning
September 12, 1980, and ending October 11, 1980.
2. That accordingly, the Illinois Central Gulf Railroad be ordered to
compensate Carman A. C. Johnson for all lost time, all overtime he is
being deprived of, all vacation rights, and any other benefits that
he was entitled to while suspended as a condition of employment.
3. Further, Carman A. C. Johnson was not given a fair and impartial
investigation as required under Rule 39 of the existing Agreement.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from the
Carrier that the case be withdrawn.
