Dispute: Claim of Employes:
1. That under the current Agreement, Advanced Carman Apprentice R, E.
Duncan was unjustly suspended from service for thirty (30) working
days beginning June 3, 1980, and ending July 15, 1980.
That accordingly, the Illinois Central Gulf Railroad be ordered to
compensate Advanced Carman Apprentice R, E. Duncan for all time lost in
the amount of eight (8) hours per day at the pro rate rate beginning on
June 3, 1980, up to and including July 15, 1980; and in addition all
time to be applied for vacation purposes and in the computation of his
apprenticeship to become a journeyman and any other benefits he would be
entitled to as a condition of employment.
3. That Advanced Carman Apprentice R, E. Duncan was not afforded a fair and
impartial hearing as required under Rule 39 of the current Agreement.

Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to Organization in ex parse form,
hearing thereon was waived, and the Division is now in receipt of a request from the
Carrier that the case be withdrawn.
