1. That under the current Agreement the action of the Consolidated Rail
Corporation (Conrail) in the removal of Electrician T. M. Salay
from service and his eventual dismissal on September 25, 1980 was
unjust, arbitrary and capricious.
That accordingly, the Consolidated Rail Corporation (Conrail) be
ordered to restore Electrician T, M. Salay to service with his
seniority rights, and all benefits unimpaired and compensated for
all time lost.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the Employes that the case be withdrawn.
