The Employees-Petitioners in this case, James D. Denton and Billy R, McCrary, seek reinstatement to their positions as Carmen, with full backpay and restoration of all employment benefits, on the grounds that they were wrongfully discharged by the Employer on November 10, 1980. As the Employer failed to provide a fair and impartial hearing to Petitioners prior to their discharge, and further failed to substantiate the alleged reasons for their termination, the discharge of Petitioners in this case was wholly improper and unjustified, and accordingly should not be sustained.

Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to Individuals in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the employes that the case be withdrawn.
