The Second Division consisted of the regular members and in
addition Referee James F. Scearce when award was rendered,

Parties to Dispute:

Dispute: Claim of Employes:
1. That Laborer Carl Edward Curtner was unjustly removed from service
on July 21, 1980, without just cause.
2. That accordingly, the Illinois Central Gulf Railroad be ordered to
compensate Carl Edward Curtner, Laborer on the Illinois Central Gulf
Railroad, for eight (8) hours a day, at the appropriate rate, for
every day Laborer Curtner would have been eligible to work between
July 12, 1980 and May 28, 1981. Furthermore, we are claiming all
benefits that are a condition of employment and reimbursement of all
losses sustained on account of loss of coverage under Health and
Welfare and Life Insurance Agreements during the time he was held
out of service.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the Carrier that the case be withdrawn.
