1.That the Missouri Pacific Railroad Company violated Rules 26 (a), 116, 117
and 121, September 22, 1980 at Freeport, Texas when they used other than
Carmen to inspect and bad order freight cars at that point.
Statement:
That the Missouri Pacific Railroad Company be ordered to compensate Carmen
J. Reyna, C. T. Parker, L. T. Reyna, A. Aquiere and R. Lopez, four (4)
hours each for the dates September 26, 1980, October 1,2, 5 and 7, 1980
The above question was submitted to the Second Division of the National Railroad
Adjustment Board by the above referred to organization in ex parte form, hearing;
thereon was waived, and the Division is now in receipt of a request from the
Carrier that the case be withdrawn.
