1. That the Missouri Pacific Railroad Company violated Rules 8 (b) and
30 of the controlling Agreement at Memphis, Tennessee, July 30, 1980
when they paid Carman R. E. Wulff as a Carman when he was working as
a Foreman.
That the Missouri Pacific Railroad Company be ordered to compensate
Carman G. L. Dye in the amount of eight (8) hours at the punative
rate for their violation of July 30, 1980.

Statement:
The above question was submitted to the Second Division of the National Railroad
Adjustment Board by the above referred to organization in ex parte form, hearing
thereon was waived, and the Division is now in receipt of a request from the Carrier
that the case be withdrawn.
