Dispute: Claim of Employes:
1. That the Missouri Pacific Railroad Company violated the controlling agreement,
particularly Rule 86(d), when regular assigned Wrecker Crew members
C. R. Watkins, G. E. Rosser and L. T. Livingston were arbitrarily by-passed
for wrecking service on June 29, 1980.
2. That accordingly, the Missouri Pacific Railroad Company be ordered to
compensate Wrecker Crew members C. R. Watkins and G. E. Rosser in the
amount of twenty-eight (28) hours each at the overtime rate and Wrecker
Crew Member L. T. Livingston in the amount of thirty-six (36) hours
account not being called for derailment at Holder, Texas, June 29, 1980.
Statement:
The above question was submitted to the Second Division of the National Railroad
Adjustment Board by the above referred to organization in ex parte form, hearing
thereon was waived, and the Division is now in receipt of a request from the Carrier
that the case be withdrawn.
