1. That the Missouri Pacific Railroad Company violated Article VII of the
Agreement of September 25, 1964, as amended January 12, 1976, at
Tillar, Arkansas January 13 and 14, 1981 by using other than regularly
assigned groundmen with outside contractor to clear derailment.
2. That the Missouri Pacific Railroad Company be ordered to compensate
regular assigned groundmen, Carmen M. H. McGary, P. G. Pruitt,
P. A. Pieshoski, H. Phillips, H. E. Ison and J. D. Waddle in the
amount of twelve (12) and one-half (.5) hours at the punative rate
for each account of violation.
Statement:
The above question was submitted to the Second Division of the National Railroad
Adjustment Board by the above referred to organization in ex parte form, hearing,
thereon was waived, and the Division is now in receipt of a request from the Carrier
that the case be withdrawn.
