Dispute: Claim of gloves:

      1. That the Missouri Pacific Railroad Company violated Article VII of Agreement of December 5, 1975 when they employed and used outside contractor's groundmen on January 8, 1981 at derailment that occurred on January 7, 1981 at Jane Ball Drive just outside yard limits of their facility at Alexandria, Louisiana.


      2. That the Missouri Pacific Railroad Company be ordered to compensate Carmen J. B. Ladd, J. Wells, K. Daigrepont, L. Daenen, M. Juneau, T. P. Lemoine and C. R. Eli in the amount of four (4) hours at the punative rate.


Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing; thereon was waived, and the Division is now in receipt of a request from the Carrier that the case be withdrawn.
