Dispute: Claim of Employes:
1. That in violation of the current agreement, Mr. Edward Gutierrez,
laborer, Chicago, Illinois, was unjustly suspended forty-five (45)
days (February 4 thru March 20, 1981) from service following a
hearing held on the date of January 19, 1981.
2. That, accordingly, Chicago and NorthWestern Transportation Company
be ordered to compensate Mr. Gutierrez for all time lost at the
pro rata rate, and any reference to this incident stricken from
his personal file.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
