Dispute: Claim of Employes:

          1. Under the current controlling Agreement, Mr. J. L. Simms, Laborer, Chicago, Illinois, was unjustly dealt with when assessed a fifteen (15) day deferred suspension, following a hearing held on February 19, 1982.


          2. That accordingly, Chicago NorthWestern Transportation Company be ordered to remove any reference of a fifteen (15) day deferred suspension from Mr. Simms personal file. In the event that the deferred suspension is invoked under the probationary period of one year; then this Claim will be also for payment of all time lost at the pro rata rate.


Statement:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the employes that the case be withdrawn.
