Dispute: Claim of Employes:
1. That at the Rutherford Enginehouse on April 20, 1981, Consolidated
Rail Corporation (Conrail) violated the controlling agreement when
Shop Superintendent D. Plum improperly removed Electrician E.
Alberts from service without a fair and impartial hearing.
2. That the charges of insubordination filed against Electrician E. Alberts
by the Carrier were false.
3. That accordingly, the Consolidated Rail Corporation (Conrail) compen-,
sate Electrician E. Alberts for all wages and benefits lost during
his period of suspension and his record cleared of all charges.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
