Dispute: Claim of Employes:
1. That the Missouri Pacific Railroad Company violated NOTE to Rule 5 of the
June 1, 1960 controlling Agreement and Article III of the National Agreement
signed June 5, 1962 when they denied Electricians J. C. Hixson, D. Gallany
and L. W. Marler their contractual right to five (5) days notice regarding
the holiday, January 1, 1980 and the opportunity for eight (8) hours each
holiday overtime pay for that holiday.
2. 'That, accordingly, Carrier be ordered to compensate Electricians J. C.,
Hixson, D. Ballany and L. W. Marler five (5) days, eight (8) hours
each day at the pro rata rate and eight (8) hours at the time and onehalf rate for Tuesday, January 1, 1980 New Years Day.
Statement:
The abovg question was submitted to the Second Division of the National
Railroad Adjustment Board by the-above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
