Dispute: Claim of Employes:
1. That the Missouri Pacific Railroad Company violated Rule 24 (a) and Rule 1
of the Communications Agreement effective August 1, 1977; and, Article
III of the September 25, 1964 Agreement when Carrier assigned other
(a Western Union Maintainer) to perform Communications Maintainers'
work on September 26 and 29, 1980, thus, depriving Communications Maintainer
Heise of his contractual rights under the provisions of the Agreement.
2. That, accordingly, the Missouri Pacific Railroad Company be ordered to
compensate Communications Maintainer H. G. Heise eight (8) hours at the
punitive rate for September 26 and 29, 1980.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
