1. That the Missouri Pacific Railroad Company violated Rule 5 and the NOTE
therein of the June 1, 1960 controlling agreement when they denied
Electricians J. T. VanHorn, D. E. Brandon, L. E. Jones, S. D. Vanderlinden,
G. G. Lonon, D. E. Bourland, J. 0. Stringham, D. L. Jefferson, R. W.
Palmquist, Jr., R. R. Richardson, and P. E. Lamborn their contractual
rights of assignment to work the holiday, January 1, 1981, thereby
depriving each and every Claimant the opportunity for eight (8) hours
holiday overtime pay for that holiday:
2. That, accordingly, Carrier be ordered to compensate each claimant,
Electrician J. T. VanHorn, D. E. Brandon, L. E. Jones, S.. D. Vanderlinden,
G. G. Lonon, D. E. Bourland, J.
0.
Stringham, D. L. Jefferson, R. W.
Palmquist, Jr., R. R. Richardson, and P. E. Lamborn, eight (8) hours
each at the time and one-half rate for the Legal Holiday, New Year's
Day, Thursday, January 1, 1981.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
