Dispute: Claim of Employes:
1. That the Missouri Pacific Railroad Company violated NOTE to Rule 5 of
the June 1, 1960 controlling agreement when they denied Electricians
J. C. Bussard, L. B. Morris, G. G. Lonon, V. E. Herbert, and D. L.
Crawford their contractual rights to five (5) days notice regarding the
holiday, January 1, 1981, at Kansas City, Missouri.
2. That, accordingly, Carrier be ordered to compensate each Claimant,
Electricians J. C. Bussard, L. B. Morris, G. G. Lonon, V. E. Herbert, and
D. L. Crawford, five (5) days, eight (8) hours each day, December 27
through December 31, 1980 at pro-rata rate for having been deprived
their contractual rights under the NOTE to Rule 5.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte form,
hearing thereon was waived, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
