Parties to Dispute:
 
( Seaboard Coast Line Railroad Company
Dispute: Claim of Employes:
1. That in Hialeah, Florida, Hialeah Car Department, beginning October 23.,
 
1978 through current date, current date inclusive, the Seaboard Coast
 
Line Railroad Company violated the controlling Agreement, in particular
 
Rule 32, when promoted Electrician Apprentice M. D. Rolle was unjustly
 
suspended and subsequently dismissed from service.
2. That the Seaboard Coast Line Railroad Company violated the current
 
Agreement when they failed to afford the Claimant M. D. Rolle a fair
 
and impartial hearing onDecember 28, 1978.
3. That accordingly, promoted Electrician Apprentice M. D. Rolle be
 
compensated at the amount of eight (8) hours per day at the pro rata
 
rate of Machinists` pay commencing October 23, 1978 and ending the
 
day Mr. Rolle is reinstated to the position of Electrician at
 
Hialeah, Florida, both dates inclusive. In addition, Mr. Rolle be
 
allowed all other benefits that accrue to his position.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the employes that the case be withdrawn.
